International Addendum

This Addendum applies to consumers outside the United States ("International Jurisdiction"). It supplements or, where stated, replaces parts of our Terms of Service. If there is a conflict, this Addendum controls. Capitalised terms have the meaning given in the Terms of Service.
1. Your content
Section 5 of the Terms of Service is replaced by the following: You retain all rights in Your Content. You grant us a non-exclusive, royalty-free, worldwide licence to host, process, and display Your Content in accordance with the Terms and applicable data-protection law, for the duration of protection provided by applicable law. The licence ends when Your Content is deleted, subject to short-term backups and legal retention obligations. We do not train AI models that serve other customers on Your Content.
2. Statutory warranties preserved
The following is added to Section 15 of the Terms: notwithstanding the warranty disclaimers in that section, you are entitled to all statutory warranty rights under applicable law, including under the EU Digital Content and Digital Services Directive (Directive 2019/770) and the EU Sale of Goods Directive (Directive 2019/771) where applicable.
3. Limitation of liability
Section 16 of the Terms is replaced by the following:
To the fullest extent permitted by applicable law, we will not be liable for any indirect, consequential, incidental, or special damages or lost profits, even if advised of the possibility.
Where permitted by applicable law, material damages and pecuniary loss due to negligent breach of essential contract obligations are limited to foreseeable damages typical of the contract at the time of conclusion. Any limitations or exclusions also apply to the personal liability of our employees, legal representatives, and vicarious agents.
Our total liability is limited to the greater of USD 200 or the amount you paid us in the preceding 12 months.
These limits do not apply to:
(a) gross negligence, fraud, or intentional misconduct;
(b) death or personal injury caused by negligence or worse;
(c) liability under the German Product Liability Act (Produkthaftungsgesetz) or equivalent product-liability regimes; or
(d) any liability that cannot be excluded under applicable law.
4. Refund policy and right of withdrawal (EU/EEA, UK, Switzerland consumers)
14-day refund policy
You may request a full refund within 14 calendar days of purchase by emailing [email protected]. After 14 days, no refunds are issued. This policy honors the EU right of withdrawal under Article 9 of Directive 2011/83/EU (in Germany, section 355 of the Civil Code).
Cancellation of subscriptions
You may cancel your subscription at any time. Access continues until the end of the current paid period. No partial-period refunds are issued. Cancel via Settings > Billing or by emailing [email protected].
5. Dispute resolution
The following is added to Section 17 of the Terms. You may resolve a dispute by JAMS arbitration as set out in Section 17, by a recognised arbitration body in your country of residence, or, where local law forbids arbitration of consumer disputes, in the courts of your country of residence. If we bring proceedings against you outside your country of residence, you have one month from notice to opt for the courts of your country of residence.
The European Commission provides an online dispute-resolution platform at ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution.
Nothing in this Addendum or the Terms affects your right to rely on mandatory provisions of the law of the country in which you reside.
6. Governing law
The following is added to Section 18 of the Terms. Where mandatory consumer-protection law in your country of residence applies, those mandatory provisions prevail over the choice of New York law. EU/EEA, UK, and Swiss consumers retain the protection of Article 6(2) of Regulation (EC) No 593/2008 (Rome I).
7. Data-protection representative

8. Miscellaneous
These Terms are concluded in English. Translations are for convenience only; the English version controls except where mandatory local law requires otherwise. All references to days are calendar days in the Gregorian calendar.
